Welcome to Nourish Us. These Terms & Conditions explain how you may use our website, join our waitlist and, when purchasing is available, order our products. In these terms, “Nourish Us”, “we”, “us” and “our” refer to Nourish Us Pty Ltd (ABN 67 652 406 472), trading as Nourish Us. You can contact us at hello@nourishus.com.au.
These terms apply to the Nourish Us store at nourishus.com.au and its dev.nourishus.com.au storefront. Please read them alongside our Privacy Policy and any specific offer or delivery conditions shown before you place an order. By using our website or placing an order, you agree to the terms that apply to that activity.
1. Your consumer rights come first
Nothing in these terms removes or reduces rights that the law gives you, including under the Australian Consumer Law. If another part of these terms conflicts with a right that cannot legally be excluded, that right takes priority. Any additional guarantee we offer is separate from, and does not replace, your statutory rights.
2. Our pre-launch website and waitlist
Nourish Us is preparing to launch Her Vitality. Before a product is available to purchase, launch dates and preview details are estimates and may change as development and production progress. We will identify material changes when communicating updated launch information.
Joining the waitlist is free. It is an expression of interest, not an order, paid reservation or commitment to buy. It does not authorise a charge or guarantee stock, a particular delivery date or a discount. Any early-access opportunity or launch bonus will have its eligibility and availability explained when it is offered.
The purchasing provisions below apply only when we make products available to order. A waitlist registration does not become a paid pre-order automatically. If we offer pre-orders, we will explain the payment arrangements, expected dispatch period and cancellation conditions before you commit.
3. Product and wellness information
Our website provides general information about our products and wellbeing. It does not provide individual medical advice or a diagnosis or treatment plan. Product descriptions and customer experiences are not a promise that everyone will experience the same result.
Read the current ingredients, allergen information, directions and warnings before using a product. Follow the label and storage instructions. Ask an appropriately qualified health professional about suitability if you are pregnant or breastfeeding, take medication, have a medical condition or are unsure whether a product is appropriate for you. Do not disregard professional advice because of information on this website.
We aim to present products accurately. Screens and lighting may affect how colours appear. Preview packaging may change before launch; the information available when you order describes what you are buying. We will not use a packaging change or a statement about individual results to deny rights relating to a faulty, unsafe or misdescribed product.
4. Using the website and your account
Please provide accurate contact and order details and update them when necessary. You must have legal capacity to make a purchase and be authorised to use the payment method you select. If you create an account, keep your sign-in details secure and let us know if you suspect unauthorised access.
You must not use the website for fraud, impersonation or unlawful activity; upload malicious software; access another person's account without permission; interfere with the store's operation; or infringe another person's privacy or intellectual property rights.
We may restrict access where reasonably necessary to address a security threat, unlawful activity or a material breach of these terms. Where practicable, we will explain the reason and give you an opportunity to resolve the issue. A restriction does not remove your rights concerning orders already paid for.
5. Orders, availability and payment
When checkout is available, review the products, quantities, delivery details and total price before paying. Available payment methods will be shown at checkout. Please keep your order confirmation and contact us promptly if any details are incorrect.
We may decline an order before accepting it for a reasonable reason, such as unavailable stock, unsuccessful payment, a delivery restriction disclosed before ordering or reasonably suspected fraud. If we cannot fulfil an order for which you have paid, we will notify you and promptly refund the unfulfilled products and any delivery charge attributable to them. We will not substitute a materially different product without your agreement.
If an error affects the price or description of your order, we will explain it and discuss the available options with you. We will not charge a higher amount without your express agreement. Nothing in this section gives us an unrestricted right to cancel a binding order or overrides your legal remedies.
6. Prices and offers
Our Australian store displays prices in Australian dollars (AUD), unless a different currency is clearly identified. Australian consumer prices include GST where applicable. Delivery charges and any other charges payable to us will be disclosed before you complete checkout.
We may change prices for future purchases. A later price change does not change an order already agreed with you. Any discount, bundle, launch bonus or promotion is subject to the eligibility, expiry and other conditions disclosed with that offer. We will honour the offer conditions applicable when you purchase.
These terms do not enrol you in a subscription or authorise recurring payments. Any future recurring purchase arrangement would require separately disclosed terms and your agreement.
7. Delivery and delays
Available delivery destinations, charges and estimated timeframes will be shown before you order. An advertised launch month is not a dispatch or delivery promise for an individual order.
Check that your delivery address is complete and accurate. If it needs correcting, contact us promptly; changes may no longer be possible after dispatch. We will discuss any necessary redelivery arrangements and disclosed costs with you before charging them.
If your parcel is missing, damaged or significantly delayed, contact us so we can investigate and arrange an appropriate outcome. We remain responsible for our obligations to you and will not require you to pursue a courier instead of us. Where a delay affects your legal entitlement to cancel or obtain a refund, that entitlement continues to apply.
8. Order changes and cancellations
If you want to change or cancel an order, email us as soon as possible with your order number. We will tell you whether the request can be accommodated, taking account of whether the order has already been prepared or dispatched. This process does not limit any cancellation or refund right you have by law or under a specific offer.
9. Returns and refunds
Change of mind and product results
We do not offer refunds or exchanges simply because you change your mind, dislike a product's taste or texture, or do not experience your preferred results. This applies to both opened and unopened products. We do not offer a trial-based money-back guarantee unless expressly stated in a specific offer available when you purchase.
These exclusions do not apply where a product is faulty, unsafe, not as described, fails to meet a consumer guarantee or gives rise to another legal right to a remedy. In particular, we will not treat a failure to meet a product claim or an applicable fitness-for-purpose guarantee as mere dissatisfaction with results. Any additional return promise made at the time of your purchase will be honoured.
Damaged, faulty or incorrect products
If you purchased directly from the Nourish Us online store and received a damaged, faulty or incorrect product, email hello@nourishus.com.au with your order number, proof of purchase and a description of the issue. Please include photographs if they would help us assess the problem. We will investigate and arrange the appropriate refund, replacement, repair or other remedy, taking account of your rights under Australian Consumer Law.
Please report problems as soon as reasonably possible, preferably within 30 days of purchase. This is a request to help us resolve issues promptly, not a deadline for your legal rights. Claims made later will still be assessed in accordance with applicable law.
Returning a product and receiving a refund
Contact us before sending a product back so we can provide return instructions and arrange collection or return postage where appropriate. We may reasonably assess the product and request information needed to establish the issue. Take reasonable care of it while your claim is being resolved. Original packaging is not required to exercise your statutory rights.
We will cover reasonable return costs where required by law, including where a product fails to meet a consumer guarantee or we supplied the wrong item. Refunds due will be processed promptly, normally to the original payment method; the time funds take to appear may depend on your payment provider.
Purchases from other retailers
If you bought a Nourish Us product from another retailer, contact that retailer to request a refund or exchange under your purchase contract. This does not remove any rights you may have against Nourish Us as a manufacturer or otherwise under applicable law.
Your Australian Consumer Law rights
Our products are covered by consumer guarantees that cannot be excluded. For a major failure, you may choose a refund or replacement. For a minor failure, you are entitled to have the problem remedied within a reasonable time, with further remedies available if it is not. You may also be entitled to compensation for reasonably foreseeable loss caused by a failure to meet a consumer guarantee. These rights apply to sale items as well as full-price products and are not limited by this policy's exclusions or the 30-day reporting request.
10. Privacy and communications
Our Privacy Policy explains how we handle personal information, including information used by Shopify to operate the store.
We send marketing communications where we have the consent required by law. Using the website or making a purchase does not, by itself, require you to agree to marketing. If you opt in to waitlist or other marketing updates, you can unsubscribe using the instructions in the message or by contacting us. We may still send necessary non-marketing messages about your order or a product safety issue.
11. Reviews and material you submit
If you submit a review, it should reflect your genuine experience and must not contain unlawful material or another person's confidential information. By submitting a review for publication, you allow us to display it with the name you choose to provide. We may remove spam, unlawful content or material unrelated to the product, but will not suppress a genuine review merely because it is negative. We will seek permission before using your photographs or testimonial in separate advertising.
12. Our content and third-party services
Our branding, photographs, text and designs belong to Nourish Us or their respective rights holders. You may browse and save material for personal reference. Commercial reproduction or reuse requires the rights holder's permission unless permitted by law.
Shopify hosts our online store. Payment providers and external websites may have their own terms and privacy practices. A link does not necessarily mean we endorse the external website. Using a service provider does not remove our responsibilities as the seller.
13. Website availability and responsibility
We take reasonable care in maintaining our website, but access may occasionally be interrupted by maintenance or technical problems. Please tell us about errors so we can investigate.
Responsibility for loss is determined by applicable law. These terms do not exclude liability for our fraud or negligence, or liability that cannot lawfully be excluded. We do not require you to waive consumer rights or reimburse us for losses caused by our own conduct.
14. Updates to these terms
We may revise these terms to reflect changes to the website, our products or legal requirements. We will publish the revised version with an updated date and give additional notice where appropriate or required by law. Revisions apply prospectively. They do not retrospectively change an existing order or remove an accrued right without your agreement.
15. Questions, disputes and applicable law
Please email us if you have a question or complaint, explaining what happened and the outcome you seek. We will consider your concern and work with you towards a resolution. Contacting us does not prevent you from approaching a consumer protection agency, court or tribunal, or seeking urgent relief.
These terms are subject to Australian law and any mandatory consumer protections applicable where you live. They do not require you to give up access to a court or tribunal otherwise available to you. If a provision is unenforceable, the remaining provisions continue to apply to the extent they can operate without it.
